Bail Recovery Agent...what is that?

In Arizona law, a bail recovery agent (commonly known as a bounty hunter) is an individual hired by a bail bond agent to locate, apprehend, and surrender a defendant who has failed to appear in court. 

What are the requirements to be a recovery agent?

Under Arizona Revised Statutes § 13-3885, a bail recovery agent is legally defined by several criteria and restrictions: [1]

  • Background Checks: They must never have been convicted in any jurisdiction of theft, a felony, or any crime involving the carrying or illegal use/possession of a deadly weapon or dangerous instrument. They must submit fingerprints to the Department of Insurance and Financial Institutions for background checks. [1, 2, 3]
  • Authorization: To make an arrest, the agent must have written authority from a licensed bail bond agent. [1, 2]
  • Prohibited Conduct: Agents are strictly forbidden from entering an occupied residential structure without consent, impersonating a law enforcement officer, or wearing any badge or uniform that implies they work for the state or federal government. [1, 2]

    Attorneys and active law enforcement officers acting in their official capacities are exempt from this definition
